במסגרת חוק ההתייעלות הכלכלית לשנת 2023 וכחלק מהתמודדות רשות המסים עם התופעה של הפקת חשבוניות מס שלא כדין (חשבוניות פיקטיביות) תוקן חוק מס ערך מוסף כך שהחל מה- 5.5.2024 יחול שינוי של ממש בנושא הפקת חשבוניות מס.
בפרק המסים בחוק ההסדרים לשנים 2023-2024, נוספה רגולציה שתשפיע על כל עסק שיפיק חשבונית לעסק אחר (כלומר, בתצורת B2B) בסכום העולה על 5,000 שקלים (יחל ב- 25,000 שקלים וירד בהדרגה בין השנים 2024-2028). הרפורמה המכונה "מודל הקצאת חשבוניות" כוללת הגבלה על ה"קונה" בעסקה, שאם יקבל חשבונית שלא קיבלה מספר אישור מרשות המסים – לא יוכל לקזז את המע"מ.
תיקון זה מחייב היערכות מוקדמת של כל העוסקים המורשים ובעיקר של עוסקים המשתמשים במערכות שאינן תוכנות מדף לצורך הפקת חשבוניות מס.
מטרת החוק היא התמודדת עם תופעת החשבוניות הפיקטיביות (דוגמאות: חשבונית שהונפקה לצורך קיזוז הוצאות בלבד עבור הכרה בהכנסה, כהוצאה לצורך מס, ובפועל עושה שימוש בחברה פיקטיבית. חשבונית שמבוססת על עסקה ממשית אך הוצאה במטרה להונות את רשויות המס).
בעסקה בין שני עסקים (שאינם פטורים), ה'קונה' בעסקה משלם את המע"מ, ה'מוכר' מעביר את סכום המע"מ לרשות המסים, ובמעמד העסקה מפיק חשבונית מס שבאמצעותה יכול הקונה להזדכות עליו. התופעה בה צד הקונה מקבל החזר ממע"מ עבור סכום שלא הועבר ע"י המוכר לרשות המסים, מוערכת בהפסדים של מיליארדי שקלים לקופת המדינה.
החל ב 1.1.25 ירד רף החשבוניות הדורשות הקצאה ל-20,000 ש"ח.
הרגולציה תחול על כל העסקים המפיקים חשבוניות בתצורת B2B כלומר, בין עסק אחד לאחר. עסקים נדרשים לבחון את אופן קליטת הנתונים במערכות, דיווח על בסיס מזומן, הוצאת חשבונית עסקה טרם הוצאת חשבוניות המס המתייחסות אליה, חשבוניות מס מיוחדות כגון חשבוניות מס עצמיות (למשל בגין יבוא שירותים מחו"ל), חשבוניות מס התחשבנות, הודעות זיכוי, חשבוניות מס בתוך איחוד עוסקים ועוד.
רשות המסים נמצאת בתהליך פיתוח מערכת שתקצה את המספר במעמד העסקה. המערכת המקוונת של רשות המיסים לצורך הקצאה ידנית טרם הוצגה ולכן עדיין אין מידע מדויק בנוגע לנראות והפונקציונליות. הרשות מתכננת הקצאה של מספרי חירום שניתן יהיה לעשות בהם שימוש במקרה של תקלה.
רשות המיסים תוכל לסרב להקצות מספר הקצאה אם יש חשש שחשבונית המס תוצא שלא כדין. במקרה כזה, רשות המיסים תעדכן את בית העסק את העילה שבגינה הוחלט שלא להקצות מספר חשבונית בהודעה מקוונת.
על החלטה שלא להקצות מספר חשבונית יוכל העסק לבקש מרשות המיסים לקיים שימוע, שיתקיים תוך שני ימי עסקים, וההחלטה לגביו תינתן תוך יום עסקים אחד.
על כל עוסק לבחון את השלכות התיקון לפי נסיבותיו והתוכנה עימה הוא עובד, לרבות בנושאים שלא הוזכרו מפורשות בתיקון: אופן קליטת הנתונים במערכותיו (הן בצד העסקאות והן בצד התשומות), דיווח על בסיס מזומן והוצאת חשבונית עסקה טרם הוצאת חשבוניות המס המתייחסות אליה, חשבוניות מס מיוחדות כגון חשבוניות מס עצמיות (למשל בגין יבוא שירותים מחו"ל), חשבוניות מס התחשבנות, הודעות זיכוי, חשבוניות מס בתוך איחוד עוסקים ועוד.
רשות המיסים מצפה מכל בתי העסק להיות מוכנים בזמן לרגולציה החדשה ולא מתוכננות החרגות לבתי עסק ללא קשר לתוכנה בה הם משתמשים. עסקים שיעבדו עם חשבוניות מקוונות יוכלו לקבל את האישור בהליך פשוט יותר.
